In Landor v. Louisiana Department of Corrections and Public Safety, will the Supreme Court rule that Damon Landor may sue a government official in his individual capacity for damages for violations of the Religious Land Use and Institutionalized Persons Act (RLUIPA)?

Damon Landor, a devout Rastafarian, sued Louisiana state officials in their individual and official capacities because prison officials forcibly shaved his head while in custody, which violated his religious beliefs (Oyez). The district court dismissed claims as to persons in their individual capacities and Fifth Circuit affirmed, with both courts being bound by precedent that the RLUIPA does not permit officials to be sued in their individual capacities, and the Supreme Court agreed to hear the case (NBC News, Fifth Circuit Decision 14 September 2023). The Supreme Court is expected to hand down its decision in its 2025 term, but if it does not, the question will close as "No." If the Court decides this case without addressing this question's particular issue or issues of law, the question will close as "No."
