In 2026, will the proponent of the California Public Benefit AI Accountability Act, which could have implications for OpenAI's conversion from a nonprofit organization, collect enough signatures for the measure to become eligible for the ballot, according to the California Secretary of State?

In late 2025, California resident Alexander Oldham filed paperwork for a new ballot measure that could seek regulatory changes that would impact OpenAI, among others (Politico, Politico, Ballotpedia). As of the launch of this question, the California Attorney General will have the ballot measure title and summary issued to the Secretary of State on or about 4 February 2026 (California Secretary of State, see "25-0033"). If/When the proponent is cleared to begin collecting petition signatures, the closing date will be changed to the day before the deadline for the signatures to be submitted (e.g., California Secretary of State - 23 January 2025). The outcome will be determined by reports and announcements from the California Secretary of State. The sufficiency and eligibility of the signatures must be confirmed by the California Secretary of State to count. If the California Secretary of State announces an extension of the deadline to collect signatures to a later date in 2026, the closing date will be extended (e.g., California Secretary of State - 17 November 2020). If the California Secretary of State announces an extension of the deadline to collect signatures to a date after 31 December 2026, the question will close "No" upon the announcement of that extension.
