The US Justice Department has issued subpoenas to Walz, among others, over potential obstruction of immigration enforcement (The Hill, CBS News). Any criminal charge under seal will only count upon the unsealing of the charge during the question's open period (Cornell - Charge, see Definition [1]). Whether Walz is governor as of being criminally charged is immaterial.
