When will a US federal court issue declaratory and/or injunctive relief preventing the Trump administration from imposing its $100,000 payment for "H-1B" visas?

Challenges

On 19 September 2025, the Trump administration announced a new $100,000 fee on "H-1B" visas, which are issued to foreigners with special knowledge and skills (White House, USCIS). The US Chamber of Commerce, a group comprised of US businesses, sued to block the fee, saying that President Trump exceeded his authority and violated the Administrative Procedure Act (APA) by imposing the fee (Chamber of Commerce Complaint 16 October 2025, US Chamber of Commerce, Yahoo [Bloomberg]). A preliminary or permanent injunction preventing enforcement will count, as will a declaratory judgment that the fee is illegal (Cornell - Declaratory Judgment, Cornell - Injunctive Relief). A settlement between the parties that would prevent the enforcement of the ban will count, and the relief must take effect to count. Relief for one or more named plaintiffs will count.
